What is litigation and dispute resolution?

Litigation and dispute resolution encompass the processes by which legal conflicts and claims are resolved. Litigation refers to the formal court-based procedure where a judge or jury examines evidence to make a binding decision. Dispute resolution covers a broader range of methods, including litigation, arbitration, mediation, and negotiation, which aim to settle disputes outside of court. These alternative methods are often more flexible, quicker, and sometimes less costly, with parties working collaboratively to reach a mutually agreeable solution. Both litigation and dispute resolution seek to provide a definitive outcome to legal disagreements.

What is the standard dispute resolution process?

The standard dispute resolution process typically begins with negotiation, where the parties involved attempt to reach an agreement informally. If negotiation fails, they may proceed to mediation, where a neutral third party facilitates discussion to help find a resolution. Should mediation be unsuccessful, arbitration might be the next step, where an arbitrator hears evidence and makes a binding decision. If all else fails, litigation is the final recourse, involving a formal court process where a judge or jury makes a legally binding ruling on the dispute. Each step offers a progressively more structured approach to resolving conflicts.

What is a dispute resolution hearing?

A dispute resolution hearing is a formal meeting where the parties involved in a disagreement present their cases to an impartial adjudicator, such as a judge, arbitrator, or mediator. During the hearing, each party typically has the opportunity to provide evidence, argue their position, and respond to the other party's claims. The objective is to reach a resolution to the dispute, either through a binding decision made by the adjudicator in the case of arbitration or a court, or through a mutually agreed-upon settlement facilitated by a mediator in mediation sessions.
