Sara Wilson and Francesca Heath-Clarke write for People Management on new flexible working request rights

Flexible working is a broad term used to describe “any working arrangement that meets the needs of both the employee and employer regarding when, where and how an employee works”. Examples include part-time working, home working, hybrid working, flexi-time and job sharing.

Currently, to be entitled to make a statutory request, an employee needs to have been continuously employed for a period of at least 26 weeks. The implementation of the Flexible Working (Amendment) Regulations 2023, however, means that, as of 6 April 2024, the right to make a statutory request will be a ‘day one’ right with no minimum length of service required. The regulations apply to England, Scotland and Wales.
