CoStar, Property Week and Architects' Journal quote James Souter on a high-profile 'rights to light' case concerning City of London's £300m Salisbury Square development
The City of London's planning and transportation committee has approved the use of Section 203 statutory override powers, preventing an injunction against the scheme from several neighbouring tenants, in what has turned into a high-profile 'rights to light' case.
The City of London Corporation had been warned in a planning report in December that several properties had rights of light over the development site, entitling them to file for an injunction and/or compensation, which could put the development “at risk”.

The report to committee told us several rights of light claims could prejudice the delivery of the development in the required timeframe.
"Developers in the City will be pleased to see that these powers will be used in appropriate cases, but it should be noted they will only be used as a last resort once attempts have been made to negotiate settlements with the affected owners.
