In an article for Insider Media, Felicity Chapman, Senior Associate, explores options aside from court for couples who own a business together and are in the process of divorcing.

The breakdown of a relationship can be stressful for all involved, particularly when those same indiviuals are simultaneously running a business. People are understandably worried about ending up in costly and time-consuming court proceedings, but there are ways of minimising the effects and burden of resolving the financial arrangements upon a divorce.

Alternative routes to achieving a settlement that do not involve litigating through court include:

  • Mediation
  • Collaborative process
  • Traditional negotiation
  • "Private FDR"
  • Arbitration
