Georgina advises clients on resolving contentious property issues in both the commercial and residential spheres, including in the specialist fields of telecoms and service charges.

About

In respect of commercial disputes, she has experience in advising on a broad range of landlord and tenant issues including business tenancy renewals.  Georgina frequently advises on and acts in respect of the Electronic Communications Code. In the residential space, she deals with various property management issues, ranging from service charge disputes to injunction and possession proceedings. Georgina also advises on other real property issues and has advised clients on restrictive covenants, trespass claims as well as claims for misrepresentation.

Georgina is admitted to practise in England and Wales.

Experience

  • Achieved success (both at first instance and on an application for permission to appeal) for a landlord client in opposing the grant of a renewal lease to Santander, on the basis of a proposed redevelopment (Santander UK plc v LCP Estates Limited [2018] EWHC 2193 (Ch)).
  • Successfully defended an application under section 84 of the LPA 1925 by a long leasehold tenant who sought to vary its lease user restrictions.  The decision in Edgware Road (2015) Limited v. Church Commissioners for England [2020] UKUT 0104 (LC) preserved the Church Commissioners’ ability to control the management of their estate. An application for permission to appeal was refused.
  • Secured vacant possession of a rooftop of a block of flats in Wembley against a number of telecoms operators, to allow the block to be sold for redevelopment.  Our strategic advice led to the successful conclusion of possession proceedings and a short-term Code agreement for the temporary relocation of the apparatus.
