Samantha advises clients on a range of contested will validity claims (including claims of forgery, rectification and capacity), Inheritance (Provision for Family and Dependants) Act 1975 claims and proprietary estoppel. Samantha acts for individuals, trustees, executors and charities based in the UK and abroad, regarding UK assets and estates. With a particular interest in Court of Protection matters, Samantha advises deputies, attorneys and individuals on statutory wills, misappropriation of asset claims and other contested Court of Protection applications. Summary

Samantha is experienced in advising clients on a range of contested will validity claims (including claims of forgery, rectification and capacity), Inheritance (Provision for Family and Dependants) Act 1975 claims and proprietary estoppel. Samantha acts for individuals, trustees, executors and charities based in the UK and abroad, regarding UK assets and estates. With a particular interest in Court of Protection matters, Samantha advises deputies, attorneys and individuals on statutory wills, misappropriation of asset claims and other contested Court of Protection applications.

Samantha also advises clients on removal of trustee/executor applications and trust disputes. Samantha has a great deal of experience in conducting successful mediations for clients.

Samantha is a full member of The Association of Contentious Trust and Probate Specialists (ACTAPS) an industry recognised qualification for specialism in this area of work and an Affiliate member of STEP, having passed the Qualified Practitioner Route to full qualification. Samantha regularly provide commentary in the press or legal publications on cases and current topics of discussion.

Experience highlights

  • Pursuing a successful claim in relation to a forged will and combined claim under the Inheritance (provision for Family and Dependants) Act 1975 for an adult child who was awarded half of her mother’s estate under an earlier will (and was left nothing in the forged will). Successful defending an appeal regarding the Judge’s decision not to recuse herself from the original trial
  • Obtaining a statutory will alongside an investigation into substantial misappropriation of assets by an adult child acting as an attorney, where there was also issues of professional negligence by a financial institution
  • Advising on the removal of a co-trustee in relation to a multi-million pound trust involving disagreements as to the use and distribution of the trust and concerns as to the protection of trust assets
  • Advising a deputy on issues regarding the housing needs of a person who had lost capacity to deal with their financial affairs and who needed to liquidate capital assets to meet liabilities and future care
