Co-chairing the firm’s Food & Beverage sector specialism, Olivia’s experience extends to assisting clients across diverse industries including retail, food and beverage, manufacturing, sports, entertainment and technology.
Olivia is experienced in conducting trade mark infringement and passing off proceedings, copyright and design actions as well as trade mark registry proceedings in the UK and EUIPO, and appeals to the UK courts. She also handles complaints to the Advertising Standards Authority in relation to advertising issues including comparative advertising, disputes before the Company Names Tribunal and UDRP domain name disputes.
Focusing on soft IP, brand strategy protection and disputes, her advisory role extends to complex IP issues, illustrated by recent work in relation to:
- defending an international cookware brand against claims of design and copyright infringement;
- navigating a multifaceted royalty and design/copyright dispute for a luxury consumer technology brand;
- defending against a claim of database rights infringement.
More generally, Olivia supports and protects the trade mark portfolios of a number of household names, and provides overarching strategic advice in relation to brand clearance, filing strategy, and opposition proceedings.
Olivia is an active member of the Chartered Institute of Trade Mark Attorneys (CITMA) and MARQUES, where she is a member of the Famous and Well-Known Marks Team.
Olivia is admitted to practise in England and Wales.
Experience
- Advising businesses in relation to the infringement and validity of intellectual property rights including defending an international cookware brand against claims of design and copyright infringement.
- Advising on a complex royalty and design/copyright dispute for a luxury consumer technology brand.
- Defending a claim of database rights infringement and breach of restrictive covenants.
- Advising a major restaurant brand on its trade mark portfolio and general IP protection.
- Supporting a well-known pub operator with intellectual property issues including the defence of threatened trade mark infringement proceedings, copyright infringement and passing off in relation to events hosted at its premises.
- Advising on the protection of non-traditional trade marks including colours, shapes, and packaging get up, including for Cadbury in its long running campaign for the protection of its iconic Cadbury Purple colour mark.
- Providing ongoing counsel to Formica on trade mark and copyright issues.
- Advising on and implementing brand clearance, trade mark protection and enforcement strategies for brand owners including household brands and SMEs.
- Conducting trade mark opposition, revocation and cancellation proceedings in the UK and EUIPO.
- Advising on co-existence and collaboration agreements.
