Surveyors' Webinar

Join us at our next Surveyors' Webinar where a panel of property experts will be looking at where landlords and tenants now find themselves in light of potential changes to or cessation of the forfeiture moratorium, changes to the Commercial Landlord and Tenant Relationship Code and its impact on rent concession arrangements. We'll also look at trends for how accruing rent arrears are to be dealt with going forwards and whether Covid rent suspension clauses could become market standard in light of recent case law.

The workshop will feature a panel discussion on the key legal and market changes and practice developments and will address the practical issues which landlords, tenants, investors and surveyors will face.

We will be exploring:

  • The changes introduced to the Commercial Landlord and Tenant Relationship Code and how these will affect rent concession negotiations;
  • The recent government consultation on the replacement of the moratorium on forfeiture for nonpayment of rent and CRAR and the response to this from leading institutional landlords and bodies;
  • The recent cases of Commerz Real Investmentgesellschaft mbh v TFS Stores Limited and Bank of New York Mellon (International) Limited v Cine UK Limited and others where the landlords successfully secured summary judgements for rent arrears and whether those judgments mean that the Code should be factored into rent concession negotiations.
  • Will Covid rent suspension clauses become the new norm following the 1954 Act lease renewal case involving Westfield and WH Smith?

As always, the workshop session will be interactive so there will be opportunities for you to share your views and experiences with us, and also to ask questions of our expert panel.
