MadeForMums quotes Jamie Kennaugh on financial disclosure during divorce

min read

Incomplete disclosure of assets can leave separating spouses without an accurate picture of the wealth available for division. Pensions, overseas investments and other financial interests may be overlooked when informal arrangements are made or a settlement is reached too quickly.

Information about a former partner’s employment history, financial activity and overseas connections may help identify assets that have not been disclosed. Retaining access to joint investment accounts can also provide important evidence during the disclosure process.

Jamie Kennaugh, Partner and Head of our Family team, comments in MadeForMums, explaining how individuals should carefully examine whether the information provided by a former spouse is complete:

If the husband took regular trips to Switzerland during the marriage, but omits to disclose any investments there, this is important information for a wife to recall and tell her lawyers. So too is provision of a list of employers the husband may have had during the marriage in case a pension pot has been omitted.
