Cristiana Felisi comments on the legal implications of a lost will and the presumption of revocation

min read

Private Client Partner and Head of our Milan office, Cristiana Felisi, has been featured in We Wealth discussing the complex legal issues that arise when an original holographic will cannot be found and whether its disappearance may affect the distribution of an estate.

The article examines the presumption of revocation under Italian law and the evidential burden required to prove that a missing will was not intentionally revoked by the testator.

The analysis follows recent guidance from the Italian Supreme Court on the treatment of lost or destroyed testamentary documents and their impact on succession proceedings.
