Cristiana Felisi comments in We Wealth on adoption in special cases and the change of a child’s surname

Partner Maria Cristiana Felisi has contributed an article to We Wealth examining a landmark ruling by the Italian Constitutional Court on adoption in so‑called “special cases” (adozione in casi particolari).

The Court has clarified that, where it is in the best interest of the child, judges may allow the child to take only the adoptive parent’s surname, rather than automatically adding it to the original surname. In her analysis, Cristiana explores how this decision moves away from rigid legislative rules in favour of a more flexible, child‑centred approach, and considers the implications for a child’s personal identity, family relationships and succession rights.
