The guide presents expert insights from practitioners in leading law firms and offers a comprehensive, jurisdiction-by-jurisdiction overview of restructuring and insolvency regimes across key and emerging markets worldwide.

The guide is structured to allow for easy comparison across jurisdictions, with each chapter addressing a consistent set of questions — from the availability of debtor-in-possession regimes and clawback actions, to the treatment of secured creditors, the role of courts and office holders, and the recognition of foreign proceedings.

In this chapter, the team explore the below from a UAE, DIFC and ADGM perspective:

  • What are the most commonly used corporate insolvency procedures available?
  • What options are there for debtors to obtain protection from their creditors pending or during a restructuring process?
  • What pre-insolvency, debtor-in-possession restructuring regimes can arise?
  • Are clawback claims provided for and, if so, on what basis can they be pursued?
