Tamasin Perkins writes for Wealth Briefing on the assisted dying bill and lessons from financial abuse claims

The UK's "Assisted Dying" Bill, still under consideration, has sparked debate on the importance of safeguards against coercion, drawing parallels with financial abuse claims and will disputes.

Tamasin Perkins, Private Wealth Disputes Partner, writes an article for Wealth Briefing and suggests that the existing legal frameworks for challenging wills and gifts could inform protections needed in the Bill. 

In the piece, she emphasises the complexity of detecting coercion, especially in vulnerable individuals, and proposes that the Bill include presumptions against influence, similar to those for lifetime gifts, to prevent potential abuse.

Tamasin also highlights the need for additional layers of protection, considering the difficulty in identifying coercion and the risk of undue influence, particularly for women. She advocates for addressing these issues in the legislation now to avoid future exploitation.
