Disputes involving trusts can raise complex issues, particularly where multiple beneficiaries, trustees, and cross-border considerations are involved. Understanding the options available for resolving these disputes efficiently and effectively is therefore becoming increasingly important.

This session will look into the use of arbitration as a mechanism for resolving trust disputes. Our panel will explore the advantages of arbitrating trust related claims, including confidentiality, flexibility and the enforceability of awards across jurisdictions. They will also consider the practical challenges that can arise when multiple beneficiaries and trustees are involved, the interaction between arbitration clauses and trust instruments, and the role of mediation as a complementary tool for achieving early and cost-effective resolution.
