Jersey Trade Mark Reform: What the New Regime Means for You

The Bailiwick of Jersey is replacing its secondary registration system, which depended on an underlying UK registration, with a standalone trade mark registry.  This comes into effect on 1 August 2026.

We address various client scenarios below:

You already hold a UK trade mark registration and a Jersey confirmatory registration

Your Jersey registration will carry over to the new register and remain valid but you should now note your Jersey renewal date, as this registration will need to be renewed separately.  If we act for you, we will attend to this.

You hold a (non-WIPO) UK trade mark registration but no Jersey confirmatory registration

Your UK registration will not carry over to the new Jersey Register.  If you wish to benefit from the outgoing confirmatory system, which does not involve examination (and Jersey is of commercial interest to you) you should file such an application before the deadline of 1 August 2026.  We can assist.

You hold a World Intellectual Property Organisation (“WIPO”) Madrid Protocol UK registration

Such a UK registration (properly called a “designation”) currently extends to Jersey automatically and WIPO will create a separate Jersey designation for you after 1 August 2026.  You should however note the separate renewal deadline for the new Jersey designation going forwards.

If your UK designation is pending, the above will happen once it is granted.

Shortcut: if you designate the UK before 1 August 2026 as part of your WIPO registration, you can benefit from the outgoing confirmatory registration regime.

After 1 August 2026, Jersey will need to be designated separately because a UK designation will no longer cover Jersey after that date.

You hold a European Union Trade Mark Registration (“EUTM”):

 EUTMs do not cover Jersey.  If Jersey is of commercial interest, you should seek separate trade mark protection there.
