Jane Wolstenholme

Financial Services, Retail & Leisure

Employment, Pensions & Immigration

Jane advises on pension issues for a wide range of clients including the trustees of occupational pension schemes, and UK and overseas employers in relation to the UK pension arrangements for their staff.

She supports trustees in carrying out their duties and understanding their powers and the constraints on those powers under scheme documentation, the overriding case law and legislation and the regulatory framework.

Jane helps companies deal with the pension implications of corporate reorganisations, mergers and transactions, and is particularly interested in finding ways for businesses to manage and honour their existing pension commitments while minimising the burden.

She also advises individuals on pension disputes, including both Pensions Ombudsman and High Court proceedings and the use of pensions, both in the UK and offshore, for efficient tax planning.

Jane is admitted to practise in England and Wales.

  • Advice to trustees on putting in place contingent asset arrangements with the employers and in particular in drafting and negotiating complex guarantee arrangements
  • Advice to a media business on a novel approach to a restructuring of the business to distance the pension scheme from the day to day operations while ensuring appropriate on-going funding; the employer specifically wanted to avoid a solution which would have offloaded the liabilities on the PPF
  • Advice to trustees on funding issues, including negotiations with a number of unrelated employers in the entertainment field and liaison with the Pensions Regulator
  • Advice to trustees on the extent to which amendments to scheme rules to implement sex equalisation were effective in light of case law developments
