James acts on both contentious and non-contentious insolvency matters acting for banks, financial institutions, companies, directors, trade creditors and insolvency practitioners.
In particular, James has strong experience in bringing claims for office holders including a wide variety of antecedent transaction actions against both directors and third parties. He also has considerable experience in acting for trustees in bankruptcy.
On the non-contentious side, James advises on the appointment of LPA Receivers and undertakes transactional and advisory work.
James started his career gaining invaluable practical experience working for a firm of regional insolvency practitioners working primarily on Creditors Voluntary Liquidations and Company Voluntary Arrangements.
James is admitted to practise in England and Wales.
- Acting for a client who held the benefit of a disputed arbitration award. The award was converted into a judgment, defeating the defendant’s attempt to overturn the award for serious irregularity. The defendant was then successfully made bankrupt and funds were recovered for the client.
- Acting for a Liquidator in successfully bringing a substantial action for wrongful trading, transfer at an undervalue and preference payments against a director of a chain of Indian restaurants.
- Acting for the liquidator of a company, used as a front to a multimillion pound mortgage fraud, bringing a successful action for misfeasance against a director for over £500,000.
