Currently the Privacy and Electronic Communications (EC) Directive Regulations allow cold calling by telephone, unless the subscriber has opted out under the Telephone Preference Service administered by the Direct Marketing Association.
The Unsolicited Telephone Communications Bill has been quietly making its way through the House of Lords and having passed its second reading recently moved to the Committee stage on 10 December 2013.
The short Bill has at its heart a requirement that the current Regulations referred to above should be amended to provide for an opt in via the Telephone Preference Calls Register as opposed to the current opt out.
If the Bill is passed then this will have a significant impact on the direct marketing industry. It is also a further indication that consumers are being empowered to opt in to the use of their personal data.
