European Commission opens phase 2 investigation into Mondi/Walki merger

The European Commission has opened an in-depth merger investigation into the proposed acquisition by Mondi of two industrial packaging plants currently owned by Walki. Mondi operates a number of plants across Europe manufacturing extrusion coating products (used for example for food wrapping, insulation material or envelopes). The plants Mondi intends to buy from Walki also manufacture extrusion coating products. Click here.

ORR consults on Freightliner commitments

The Office of Rail Regulation has opened a consultation on commitments proposed by Freightliner. The commitments proposal follows an ORR investigation under the Competition Act 1998 into Freightliner's arrangements with its customers for the provision of Deep Sea Container rail transport services between certain ports and key inland destinations in Great Britain. The commitments are intended to address the ORR’s concerns that Freightliner’s arrangements amount to an abuse of a dominant position by excluding access to its customers for competitors and contain resale restrictions which infringe the rules on antic-competitive agreements. Following a phase 2 review, the European Commission has approved the proposed acquisition of the energy businesses of Alstom of France by US-based General Electric. The approval is conditional on the divestiture of central parts of Alstom's heavy duty gas turbines business to Ansaldo of Italy. Click here.
