European Union publish provisional report of the Luxembourg Justice and the Home Affairs Council meeting

On the 14 October 2014 the Council of the European Union published a provisional version of a report of the Justice and the Home Affairs Council meeting held in Luxembourg on 9 - 10 October 2014.

In relation to data protection it appears that significant progress was made in relation to specific issues of the draft General Data Protection Regulation although the understanding is that:

  • “nothing is agreed until everything is agreed
  • it is without prejudice to any horizontal questions
  • it does not mandate the Presidency to engage an informal trilogues of the European Parliament on the text.”

Of particular interest to readers will be the progress made on sections of the draft Regulation relating to the role and duties of controllers and processors as well as the role and duties of the Data Protection Officer.
