The legal issues surrounding pensions can be some of the most complex and challenging to navigate. The ever changing and increasing regulatory landscape makes compliance an uphill task. Although pensions remain enormously important for both employers and individuals, employers have to control their overall pension costs, including their legal expenditure. Our multidisciplinary pensions team cuts through the complexities and offers practical solutions, delivered in plain English. We are experienced in negotiating with the Pensions Regulator and the Pension Protection Fund for our clients, and even lobbying, if necessary, the DWP and the Treasury to help resolve their issues.

Advising on schemes ranging from £3 billion to £1 million in size, we act for all parties in the pensions arena and on all types of pension arrangements - defined benefit, defined contribution, cash balance, master trusts and personal pension arrangements. We also guide clients through the intricacies of auto-enrolment.

We are particularly well used to advising US corporates, and other overseas parent companies, and their pension trustees, about UK pension issues.

We also have particular expertise in the charity sector, through our work with individual charities and our work with the Charity Finance Directors' Group, who produce 'The Charity Pensions Maze'.

Corporate support 

Advising on the pensions aspects of M&A work, including applications for clearance from the Pensions Regulator, advice on outsourcing predominantly from the public sector, management buy-outs, merging of charities, scheme abandonment issues and negotiations with the Pension Protection Fund.


Advising on the impact of pre-packs on defined benefit pension schemes and whether clearance is needed; appointment of independent trustees and Pension Protection Fund, and other, wind ups.

Pensions litigation 

Advising on rectification and professional negligence, helping employers and trustees defend allegations of mal-administration and also claims against employers by senior executives regarding contractual pension promises. The team is experienced in handling cases both before the Pensions Ombudsman and the courts.

Trustees and sponsoring employer support

Advice on scheme specific funding, employer covenant review, winding up schemes, conflicts of interest policies, risk management including buy-outs and buy-ins, use of contingent assets for security, reducing the risk based pension levy for the Pension Protection Fund and assistance on pension implications of corporate restructuring. We also advice on auto enrolment compliance.


Advising on the closure of defined benefit schemes as well as general advice on mal-administration issues and early retirement terms.

Financial services

Advice on fiduciary management arrangements, investment management agreements, custody agreements and SIPPs.

Pension providers/IFAs

Advice to high-net-worth individuals on their pension arrangements, including their tax arrangements and the impact of changes to the annual allowance and the lifetime allowance, as well as advice on overseas transfers using QROPS. 

Benefit and tax advice

Advising on reducing risk through benefit changes, transfer out and commutation exercises, advice on the introduction of salary sacrifice, compliance with age discrimination legislation and the implications of the on-going tax changes for the higher paid. We also advise on group life assurance arrangements.
