Construction & Infrastructure

Construction & Infrastructure

Charles Russell Speechlys has a notable reputation in the construction and engineering sectors. We deliver a comprehensive and integrated international service.

The civil infrastructure market is valued at trillions of U.S. dollars each decade. Your challenges in delivering high value, high profile projects may vary enormously around the world. We understand those challenges well. Having experienced, flexible and accessible commercial lawyers who are able to advise you on the procurement, structuring, delivery and financing of such projects can make all the difference in the successful and timely delivery of a project.  Our skills lie also in the drafting and negotiating of complex but clear, commercially astute contracts that help manage the multitude of risks involved.

Our flexible and highly commercial approach is designed for this fast-moving world, both in the UK and internationally from our network of offices and beyond.  We know the funders, the regulators, the landscape.  We speak the language, understand the idiosyncrasies and bring our considerable knowledge to bear on your situation: we are known for our personal approach.

We advise organisations broadly across the industry from overseas governments, other public sector bodies, Fortune 500 engineering firms, through to major contractors, specialist sub-contractors, investors, developers and consultants. We help organisations like yours across a range of markets including energy, transport, water and waste water, social infrastructure, building/construction and process engineering. We can support both your daily operations and to secure growth within your long-term strategic aims.

For each market we have experts who understand the specific issues that affect projects.  This might involve mainstream construction or engineering projects or privately financed projects for public sector organisations or PPPs. We work across a range of jurisdictions, including throughout the Middle East and in Africa. Many projects will require the drafting of bespoke documentation, but we also work with – and provide training on – all the international model forms including all the FIDIC, NEC3 and IChemE suite of contracts.

We are involved on all aspects of a project from initial procurement and bid, up to financial close, during construction of the project and the operation of the completed building or other infrastructure asset. We also have experts who advise on accommodation and other projects brought forward under various different private finance models for both the public and private sector.

At any stage of a project, be it structuring or bidding, implementation or development, asset acquisition or disposal, dispute avoidance or resolution, we will help you to drive your project forward and keep it on track.

Our experience

  • We advised Bouygues Bâtiment International on its acquisition of a majority interest in Leadbitter Group (which includes Denne Construction) from Dutch group Heijmans NV.
  • We advised WS Atkins on the sale of their facilities management division.

Joint ventures

  • We advised a market leader in the field of offshore contracting and engineering and a marine dredging contractor on a sub-sea pipeline joint venture. We initially supported the client on the European landing of this gas pipeline which is the world's largest sub-sea pipeline installation, covering a 1,200 kilometre route and transporting 55 billion cubic metres of gas each year.
  • We have extensive experience in advising private sector clients on a number of public/private partnerships across various infrastructure sub-sectors including health, social and specialist care, education, housing, blue light, waste and transportation sectors.

  • We have advised a number of infrastructure funds, developers, investors, contractors and operators in relation to numerous public/private projects across many of the infrastructure sub sectors including health, long term and specialist care, housing, education, leisure, blue light, waste and transport. Work in this area has included advising the developer and construction contractor on the £170 million Myatts Field, Lambeth North social housing PFI project, the development of the award winning £50 million Finchley Memorial Hospital in North London and acting for various Local Improvement Finance Trust companies (public/private joint venture) in relation to the development of over 30 health and community care centres across England.

Procurement advice

  • We are advising the Bahrain Government’s Ministry of Transport & Telecommunications on the USD$600m redevelopment of Bahrain’s airport in Manama.
  • We are representing a world leading engineering and design consultancy in setting aside the award of a major engineering contract by a major utilities company under the EU public procurement rules.

Construction advice

  • We advised on the construction elements of Northacre's Lancasters development - an exclusive Northacre revival scheme with 77 prime apartments overlooking Hyde Park. Formerly Lancaster Gate Thistle Hotel, this Grade II Listed terrace gained planning consent for conversion to residential accommodation. This extremely complex construction scheme involves a complete 90ft high façade retention, and restoration of the building to its original form with an underground car park beneath private landscaped gardens.

Compliance and regulatory advice

  • We represent several publicly traded US multinational construction and engineering firms in respect of compliance and regulatory matters including anti-bribery programs, ethical reporting and data privacy.

Dispute resolution

  • We are acting for an international contractor on several matters in relation to a number of high rise buildings in the City of London including a substantial multi-party cladding defects dispute and resisting calls on two bonds and the relevant counter-indemnities arising out of a Middle East project.
  • We advised a Fortune 500 organisation on a major arbitration claim in relation to the design, fabrication, construction and erection of mechanical equipment and pipework at an energy plant. We advised our clients, the subcontractor, on the merits and strategy for arbitrating the claim between themselves and the main contractor which resulted in the matter recently being settled with our clients receiving a significant settlement payment.
  • We acted for a major global engineering company on a series of substantial disputes relating to two sites in the City of London. The disputes related to the manufacture and installation of lifts and involved allegations of delay in completion and of defective work, which it was claimed had caused the project to be completed late.
